A 401(k), IRA, German statutory pension and government pension are not automatically treated the same way. The source and legal nature of the payment must be identified before determining the taxing rights.
The U.S.–Germany income tax treaty contains specific provisions for pensions, annuities, government service and social-security payments. U.S. citizens can also require a separate saving-clause analysis before relying on a treaty result.
