U.S.–Germany Foreign Partnership Reporting
German Partnership: Form 8865 Reporting for U.S. Taxpayers
A U.S. person who owns an interest in a German partnership may have Form 8865 reporting. The analysis depends on the entity's U.S. tax classification, ownership percentage, control, contributions, acquisitions and dispositions, and can create annual income, basis and foreign-tax-credit issues.
Panoramica
The German legal form does not by itself determine the U.S. filing form
A German GbR, KG, OHG or other entity must first be classified for U.S. tax purposes. If it is treated as a foreign partnership, Form 8865 may apply depending on the U.S. person's ownership, control and transactions.
German tax filings do not replace U.S. partnership reporting. The U.S. return can require detailed partner, capital, income and transaction information in addition to the taxpayer's own share of partnership income.

Form 8865 Filing Categories
Control, ownership changes and contributions can trigger reporting
Control of a foreign partnership
A U.S. person who controls a foreign partnership can face extensive Form 8865 reporting, including financial and partner information.
Ownership changes
Acquiring, disposing of or changing a significant partnership interest can create event-based Form 8865 reporting.
Contributions to a foreign partnership
Contributions of cash or property can trigger separate reporting depending on the amount, ownership and surrounding facts.
U.S. Partner Taxation
Partnership income and distributions require separate U.S. tracking
Income allocation
The U.S. partner's taxable share may need to be determined under U.S. rules rather than simply copying the German partnership allocation.
Outside basis
U.S. outside basis should be tracked separately from the German capital account because contributions, income, losses and distributions can affect it differently.
Distribuzioni
Partnership distributions can have different U.S. consequences depending on basis, property distributed and prior income allocations.
Crediti d'imposta esteri
German tax paid by or allocated to the partner may be relevant for U.S. foreign tax credits, subject to sourcing, category and timing rules.
Classification & Records
Entity classification comes before choosing the reporting form
